Last updated: 1 January 2025
These Terms of Service (“Terms”) govern your access to and use of the website https://amtmigration.online (the “Website”) and the professional business and consulting services supplied by AMT Migration Pty Ltd (ABN 88 703 127 940) of Melbourne VIC, Australia (“AMT Migration”, “we”, “us” or “our”). By accessing the Website, requesting a quote or engaging our services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Website or our services.
1. About Us
AMT Migration Pty Ltd is an Australian proprietary company registered in Victoria, Australia. We provide professional business and consulting services to individuals and organisations, including advisory, documentation and application support services. Our registered office is located in Melbourne VIC, Australia, and we serve clients across Australia.
2. Our Services
The services we offer are described on our Services page. The exact scope of work for each engagement will be set out in the applicable quote, engagement letter or service agreement provided to you before work commences. Where there is any inconsistency between these Terms and a signed engagement document, the engagement document will prevail to the extent of the inconsistency.
3. Quotes, Fees and Payment
- Quotes provided through our quote request process are estimates based on the information you supply and are valid for 14 days from the date of issue unless otherwise stated.
- Professional fees are payable in accordance with the payment terms set out in your engagement letter or invoice.
- Unless expressly stated, fees are exclusive of GST, which (where applicable) is payable in addition at the prevailing rate.
- Invoices not paid by the due date may attract reasonable late-payment charges or interest as set out in your engagement documents or as permitted by law.
4. Government and Third-Party Charges
Certain processes involve fees charged by third parties, such as government application fees, translation costs, skills-assessment charges or courier costs. Unless expressly included in your quote, these charges are payable by you directly and are separate from our professional fees. Third-party charges may change without notice, and we accept no responsibility for variations in amounts set by other organisations.
5. Your Responsibilities
When you engage our services, you agree to:
- provide complete, accurate and truthful information and genuine documents in a timely manner;
- promptly notify us of any change in your personal or business circumstances that may be relevant to your engagement;
- respond to our requests for information or clarification within a reasonable time;
- review drafts and materials we prepare and confirm their accuracy before lodgement or submission;
- comply with all applicable Australian laws and regulations.
You confirm that all information and documents you provide to us are genuine, and that it is lawful for you to seek our services. We are not able to assist with any matter involving information or documents that are false, misleading or fraudulent. If we become aware of such material, we may end the engagement in accordance with clause 10.
6. No Guarantee of Outcome
We provide our services with due care, skill and diligence. However, many outcomes depend on decisions made by government departments, agencies or other third parties, which are entirely outside our control. We do not guarantee any particular result, outcome or timeframe, and we do not guarantee that any application, submission or request will be approved, accepted or successful.
7. Consumer Guarantees Under Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies that you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded.
Our services come with guarantees under the Australian Consumer Law that cannot be excluded. You may be entitled to a resupply of the services or payment of the cost of having the services resupplied if a service failure does not amount to a major failure, and to a refund or other remedy if the failure amounts to a major failure. You may also be entitled to reasonable compensation for reasonably foreseeable loss or damage caused by such a failure.
8. Limitation of Liability
To the fullest extent permitted by law, and except where liability cannot be excluded under the Australian Consumer Law or any other applicable law:
- our total aggregate liability arising out of or in connection with the services is limited to the professional fees you actually paid to us for the relevant engagement;
- we are not liable for any indirect, incidental or consequential loss, including loss of profits, loss of opportunity, loss of business or losses arising from decisions made by third parties or government agencies; and
- we are not liable for delays or failures in performance caused by events beyond our reasonable control.
If the Australian Consumer Law applies and permits limitation of our liability for a service failure that is not a major failure, our liability may be limited to resupplying the services or paying the cost of resupply, at our election where lawful.
9. Privacy and Confidentiality
We handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. Information you provide for the purpose of an engagement will be treated as confidential and used only for the purpose of providing our services, or as required or permitted by law.
10. Cancellation and Termination
You may cancel an engagement at any time by giving us written notice. You remain liable for professional fees for work performed up to the date of cancellation, together with any third-party charges already incurred on your instructions.
We may suspend or terminate an engagement, with written notice to you, if you: materially breach these Terms or your engagement documents; fail to pay properly due fees; fail to provide requested information within a reasonable time; or ask us to act on information or documents we believe to be false, misleading or unlawful.
